Procedure

As provided for in LD Nº 1350, Legislative Decree on Migration, in Peru there are two concurrent migration authorities. One is the National Superintendence of Migration and the other is the Ministry of Foreign Affairs. Additionally, the Ministry of Foreign Affairs is the governing body of the National Migration Policy, a public policy of mandatory compliance.

Granting
  • Visas are only granted at General Consulates, Consulates and Consular Sections of Peru abroad, at the discretion of the consular officer or after approval of the respective migratory status by the competent entity (Ministry of Foreign Affairs or the National Superintendence of Migration).
  • Every visa contains a "Migratory Status" that describes and determines the activity or activities that the holder can carry out, as well as the period of authorized permanence.
  • The Consular Section of the Embassy of Peru in Sweden grants visas to citizens of Sweden and Denmark, or to foreign citizens who accredit legal residence in these countries, in the temporary migratory status of business and tourism. When the visa applicant is not a national or resident in the host country, the Consular Office must compulsorily request authorization from the Ministry of Foreign Affairs.
  • Swedish and Danish citizens can enter Peru without the need for a tourist visa. The maximum term of permanence as a tourist in Peru is one hundred and eighty-three (183) days.
  • Citizens of Sweden and Denmark do not need a visa to visit Peru in the business and journalist migratory status for a maximum of ninety (90) calendar days, either as a continuous visit or several consecutive visits, for a period of six (06) months.
Migratory Status
  • The temporary and resident migratory status that are detailed below require the express approval of the Ministry of Foreign Affairs for issuance: Special, Journalism, Cooperation, Exchange, Humanitarian, International Conventions, Consular, Diplomatic, Official, and Family Member of Officer.
  • The following temporary and resident migratory status require the express approval of the National Superintendence of Migration for their issuance and are subject to a thirty (30) day period to be collected from the Consular Office: International Agreements, Artistic or Sports, Special, Temporary Training/Research and Resident Training/Research, Temporary Worker/Designee and Resident Worker/Designee, Crewmember, Religious, Investor, Family Member of Resident, Suspended, Annuitant, Permanent and International Conventions.
Denial
  • The consular officer verifies that the beneficiary of the visa meets the necessary requirements to receive the latter, being able to carry out a personal interview if applicable, contrasting the information obtained with the requested documentation, applying the principle of discretion that corresponds to them, according to Article 364 of the Consular Regulation in force.
  • Even if a migratory status has been approved by the Ministry of Foreign Affairs or by the National Superintendence of Migration, the Consular Office may deny a visa, if its evaluation has the necessary elements that justify it.
  • The denial of a visa is final and is unappealable.
  • If the visa has been denied, the foreign citizen must wait at least six (06) months to reapply for an immigration status.
Validity of the Visa
  • The visa is extended in the foreign passport or other valid analogue travel document. The foreign person wishing to enter and/or leave Peru, must present their passport with a minimum validity of six (06) months counted from their entry into the national territory (Article 24 subsection a) L.D. Nº 1350).
  • The visa will be handed over to the foreign person at the Consular Offices of Peru in their country of origin or of habitual residence, unless expressly authorized by the Ministry of Foreign Affairs, for exceptional reasons.
  • The VALIDITY of a Visa expires if, after SIX (06) MONTHS from the date it was issued, it has not been used for admission to the national territory or at the end of the validity of the approved period of stay.
  • Once the first entry into Peruvian territory has been made, the visa will have the same validity as the period of stay approved for the migratory status.
  • Visas with migratory status approved by the NATIONAL SUPERINTENDENCE OF MIGRATION may be collected within a period not exceeding THIRTY (30) CALENDAR DAYS; term that is computed since the Ministry of Foreign Affairs is informed about the approval of the migratory status and the authorized term.
Extension and Change of Migratory Status
  • The procedures for extension and change of migratory status will be carried out by the Ministry of Foreign Affairs or by the National Superintendence of Migration in national territory, correspondingly.
  • It is not possible to grant a visa in the national territory, except by Regularization process, which must be evaluated and authorized, only by the Ministry of Foreign Affairs and in exceptional cases.
